What are Notarizations?

Rooted in the fundamentals of notarial processes – examining, certifying and recording – the term “notarization” encompasses a broad range of services. 

We refer to notarizations as documents that clients sign wherein they solemnly declare or swear under oath that statements in the documents are true. (Scroll down to see our list of common types of notarizations). 

A notary’s role in notarizing a document is to confirm the person’s identify before he or she solemnly declares or swears under oath that the statements in the document are true; the person will then sign the document in front of the notary and then the notary will sign as witness to the person’s signature and will stamp the document. 

Our notaries at Krische, Fedewich & Witt can only notarize documents that are in English or that have been translated by a certified translator.

Notarizations cannot be provided by video conference or DocuSign in BC.

COME PREPARED FOR YOUR NOTARIZATION

Bring any instructions related to your document, as well as your completed document (already filled out) but do not sign it ahead of time.

Bring two separate pieces of valid, unexpired identification:

1st piece: government ID with your name, picture and signature (driver’s license, passport, or BC services card)

2nd piece: ID with your name and signature (debit or credit card, driver’s license, passport, or BC services card)

Note: your name must exactly match on both pieces of identification that you present.

Note: The above services are related to the person whose name is on the document; therefore, that person must be physically present, in person, in front of the notary public when signing the document and/or having identification verified.

Certified True Copies of Original Documents

Certified True Copies are concerned with the document (rather than a person). Therefore, any person can bring the original document to the notary public for certification. The notary office makes a photocopy of the document and then the notary places a stamp on the document which says that the notary has viewed the original document and that the photocopy is a true copy of the original document that does not appear to be altered in any way. Critically, the document must be the original; we cannot certify copies of documents or documents printed from the internet or emails.

What are Not Notarizations?

  • Documents that are not statements of fact as described above are not notarizations.

  • Documents wherein the clients must receive legal advice before signing, including, but are not limited to:

    •  Land Title Documents & Mortgages

    • Private Debt Notes, Promissory Notes and Loan Agreements

    •  Wills & Powers of Attorney

    • Contracts & Leases

These types of documents are all examples of documents that notaries must provide advice to clients about and keep a file for ten years along with our notes that show that we assessed the clients’ mental capacity, that the clients understood the documents, and the clients signed without undue influence. We do provide some of these services, but they require longer appointments and are not considered notarizations.
